TERMS & CONDITIONS

These Terms & Conditions apply to purchases made through the CHAIN online store at chainjewellery.com.

Nothing in these Terms & Conditions limits any mandatory consumer rights that apply under applicable law.

2. APPLICATION OF THESE TERMS

These Terms & Conditions apply to orders and agreements between CHAIN and consumers purchasing through our online store.

The applicable Terms & Conditions are made available to customers before an order is placed and can be accessed through our website.

By placing an order, you agree to the Terms & Conditions applicable to that order, to the extent permitted by law.

Mandatory consumer rights remain unaffected.


3. PRODUCTS & PRODUCT INFORMATION

CHAIN offers jewellery that may include, depending on the individual product, 14K gold, 925 sterling silver and lab-grown diamonds.

We aim to describe the main characteristics of each product as clearly and accurately as reasonably possible.

Depending on the product, this information may include:

• precious metal and fineness;
• colour and finish;
• stone type;
• carat weight;
• diamond shape or cut;
• colour and clarity grade;
• dimensions and/or size;
• certification, where applicable;
• other relevant product characteristics.

Lab-grown diamonds are diamonds created in a laboratory. Where a product contains a lab-grown diamond, this will be stated in the relevant product information.

Where an individual diamond certificate from an independent gemmological laboratory is included with a product, this will be stated in the relevant product description.

Not every jewellery item or diamond is necessarily supplied with an individual certificate unless expressly stated.

We make reasonable efforts to display product photographs, colours, proportions and details accurately.

However, the appearance of a product may vary slightly due to photography, lighting, screen settings, manufacturing tolerances and other reasonable variations.

Such differences do not affect your statutory rights where a product does not conform to the agreement.


4. PRICES

Prices displayed to consumers are stated in euros and include applicable VAT unless clearly stated otherwise where legally permitted.

Any applicable shipping charges or other additional charges will be displayed before the order is completed.

We take reasonable care to ensure that prices are accurate.

In the event of an obvious pricing, typographical or technical error, we may correct the error and, where legally permitted, refuse or cancel an affected order where it should reasonably have been apparent that the displayed price was incorrect.

If we cancel an order that has already been paid, the applicable amount will be refunded.


5. ORDERS & FORMATION OF THE AGREEMENT

You are responsible for providing accurate and complete information when placing an order.

After placing an order, you will receive an electronic order confirmation.

We may refuse or cancel an order where there is a legitimate reason to do so, including suspected fraud, an obvious pricing or technical error, invalid payment information or unexpected unavailability of a product.

Where an order that has already been paid is cancelled by CHAIN, the applicable amount will be refunded using the appropriate payment method.

Nothing in this section limits your mandatory consumer rights.


6. PAYMENT

Available payment methods are displayed during checkout.

Payment may be processed by Shopify Payments and/or other payment providers made available through our checkout.

You must pay the total amount due in accordance with the payment method selected at checkout.

CHAIN does not necessarily receive or store complete payment card or banking information where this information is processed directly by an authorised payment provider.


7. MADE-TO-ORDER JEWELLERY

Certain CHAIN jewellery may be made to order.

Where a product is made to order, this will be stated where relevant on the product page or during the ordering process.

Estimated production and delivery times may vary depending on the product, selected specifications and availability.

Made-to-order status alone does not automatically remove a consumer's statutory right of withdrawal.

Where a product is genuinely made according to your individual specifications or clearly personalised for you and a statutory exception to the right of withdrawal applies, this will be communicated before the order is placed.


8. PERSONALISED & BESPOKE JEWELLERY

CHAIN may offer personalised or bespoke jewellery, including products created according to individual customer specifications.

Examples may include personal engraving, individually commissioned designs or other jewellery that is genuinely personalised specifically for the customer.

Where a statutory exception to the right of withdrawal applies to a personalised or bespoke product, this will be clearly communicated before the purchase is completed.

Selecting standard options offered by CHAIN, such as a standard ring size, metal colour or other standard product option, does not by itself automatically remove the statutory right of withdrawal.

Nothing in this section limits your statutory rights where a personalised or bespoke product is defective, damaged or does not conform to the agreement.


9. DELIVERY

Orders will be delivered to the delivery address provided during checkout.

Available shipping methods, applicable shipping charges and estimated delivery times will be communicated through our website and/or during checkout.

We aim to deliver orders within the communicated timeframe.

Production times for made-to-order or personalised jewellery may be additional to shipping time where this is clearly communicated.

If a delivery is delayed, we will provide information where reasonably possible.

Unless a legal exception applies, the risk of loss or damage remains with CHAIN until you, or a third party designated by you other than the carrier, receive the product.

10. RIGHT OF WITHDRAWAL

Consumers purchasing online generally have the legal right to withdraw from the agreement without giving a reason within 14 days.

The withdrawal period generally expires 14 days after the day on which you, or a third party designated by you other than the carrier, receive the product.

Where multiple items from the same order are delivered separately, the applicable statutory rules determine when the withdrawal period begins.

You may exercise your right of withdrawal through the return functionality available through your CHAIN customer account or by providing us with a clear statement of your decision to withdraw.

You do not need to provide a reason for exercising your statutory right of withdrawal.

After notifying us of your withdrawal, the product must be returned within the applicable statutory period.

During the withdrawal period, you may inspect and handle the product only to the extent necessary to establish its nature, characteristics and functioning, comparable to what would reasonably be permitted in a physical store.

You may be responsible for any reduction in value resulting from handling beyond what is necessary for this purpose.

11. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The statutory right of withdrawal does not apply where a legal exception applies.

This may include jewellery manufactured according to individual customer specifications or jewellery that is clearly personalised specifically for the customer, such as certain personally engraved or genuinely bespoke pieces, where the applicable legal requirements for the exception are met.

The selection of a standard option offered by CHAIN does not by itself automatically mean that the statutory right of withdrawal is excluded.

Where the statutory right of withdrawal does not apply to a specific product, this will be clearly communicated before the order is placed.

This does not affect statutory rights relating to defective, damaged or non-conforming products.


12. RETURNS & REFUNDS

Returns and refunds are governed by our Returns & Refunds Policy and applicable consumer law.

Eligible return requests can be submitted through your CHAIN customer account.

For eligible returns under the statutory right of withdrawal, the customer is responsible for arranging and paying the direct cost of return shipping unless otherwise stated or unless CHAIN is responsible for an incorrect, damaged or defective product.

Where the right of withdrawal has been validly exercised, we will refund the amounts legally due within the applicable statutory period.

Where permitted by law, we may withhold reimbursement until we have received the returned product or until you provide evidence that the product has been returned, whichever occurs first.

13. CANCELLATION REQUESTS

Where available, customers may submit a self-service cancellation request through their CHAIN customer account within 24 hours of placing an order.

Submitting a cancellation request does not automatically mean that the order has been cancelled.

We will review the request and confirm whether cancellation is still possible.

Where an order has already entered processing or production, cancellation may no longer be operationally possible.

The availability or expiry of the self-service cancellation option does not limit any statutory right of withdrawal or other mandatory consumer right that may apply.


14. STATUTORY GUARANTEE & CONFORMITY

Consumers are entitled to the statutory guarantee provided by applicable law.

Products must conform to the agreement and have the characteristics that a consumer may reasonably expect, taking into account the product description, price, nature of the product and other relevant circumstances.

Where a product does not conform to the agreement, you may be entitled to the statutory remedies applicable to your circumstances, including, where legally applicable, repair or replacement and, where the relevant legal requirements are met, a price reduction or termination of the agreement.

Any additional commercial guarantee offered by CHAIN does not limit your statutory guarantee rights.


15. NORMAL WEAR, CARE & DAMAGE

Jewellery may develop signs of normal wear over time.

Depending on the product, normal wear may include minor surface scratches, changes in shine and gradual wear to certain finishes or plating.

Damage caused by misuse, accidents, improper care or unauthorised alteration or repair does not automatically constitute a defect for which CHAIN is responsible.

However, nothing in this section limits your statutory rights where a product did not conform to the agreement at the relevant time.


16. DIAMONDS & CERTIFICATION

Where a CHAIN product contains a lab-grown diamond, this will be disclosed in the relevant product information.

Diamond characteristics may include information such as carat weight, shape, colour and clarity where relevant.

Where an individual certificate from an independent gemmological laboratory, such as IGI, is included with a particular diamond, this will be stated on the relevant product page.

CHAIN does not represent that every diamond or jewellery item is supplied with an individual laboratory certificate unless this is expressly stated for the relevant product.

Where a certificate forms part of the supplied product, it should be kept carefully and returned with the jewellery where required in connection with an eligible return.

If you have a complaint regarding a product, order or our service, please contact:

Please provide your order number and a clear description of the issue and, where relevant, photographs or other supporting information.

We aim to review complaints within a reasonable period and work towards an appropriate solution.

Your statutory rights remain unaffected.


18. LIABILITY

CHAIN is responsible to the extent required by applicable law.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by law.

Nothing in these Terms & Conditions limits any mandatory consumer rights.


19. PERSONAL DATA

We process personal data in accordance with applicable data protection legislation.

Information about how we collect, use, share and protect personal data and how you may exercise your privacy rights is available in our Privacy Policy.


20. INTELLECTUAL PROPERTY

Unless otherwise stated, intellectual property rights relating to original content on our website, including CHAIN branding, logos, original text, design elements and original imagery, belong to CHAIN or the relevant rights holder.

You may not reproduce, publish, commercially exploit or otherwise use protected content without permission, except where permitted by applicable law.


21. CHANGES TO THESE TERMS

We may update these Terms & Conditions from time to time.

The version applicable to an order is generally the version made available in connection with that agreement when the order was placed.

Changes will not retroactively reduce the statutory or contractual rights relating to an existing consumer agreement unless permitted by law.


22. GOVERNING LAW

Agreements with CHAIN are governed by Dutch law.

If you are a consumer residing in another country, this choice of law does not deprive you of mandatory consumer protections that apply to you under applicable law.

Any dispute may be submitted to the court having jurisdiction under applicable law.
